Vertragsarzte waren bisher vom Vorwurf der Bestechung und Bestechlichkeit weitgehend verschont; als eigene/r Herr/Frau im eigenen Praxisunternehmen genossen sie den Schutz von Freiberuflichkeit, Unabhangigkeit und Grundgesetz.

Damit konnte es jedenfalls in strafrechtlicher Hinsicht bald vorbei sein, wenn man den Entscheidungen der Instanzgerichte glauben will. Diese gerichtlichen Entscheidungen durften fur viele Vertragsarzte uberraschend sein und die strafrechtliche Relevanz der vertragsarztlichen Tatigkeit in der Zukunft neu beleben. Als Beauftragte" oder Angestellte" der Krankenkassen werden sich die niedergelassenen und zur vertragsarztlichen Versorgung zugelassenen Arzte zukunftig in einem vollig neuen beruflichen und strafrechtlichen Umfeld bewegen.

Die Debatte um unerwartete und unerwunschte Strafbarkeitsrisiken in der vertragsarztlichen Berufsausubung hat die Deutsche Gesellschaft fur Medizinrecht (DGMR) e.V. aufgegriffen und Empfehlungen erarbeitet, die sich sowohl an die Organe der arztlichen Selbstverwaltung und den Gesetzgeber als auch an die Angehorigen des arztlichen Berufsstandes richten. Die Empfehlungen sollen den Vertragsarzten in Klinik und Praxis helfen, mit strafrechtlich relevanten Konfliktsituationen besser umzugehen, die sich fur sie als unerwartet" darstellen. Im Ubrigen gibt die DGMR Empfehlungen ab, unerwunschte" Strafbarkeitsrisiken weitgehend auszuschliessen.
